D-9 PITTSBURGH POST-GAZETTE THURSDAY, FEBRUARY 27, 1997 Hung jury in first trial, second begins the Pittsburgh police. The police arrived and she said they stayed about five minutes and left. That evening, she said, she was cleaning up broken glass in the bedroom and standing next to Cunningham when Thompkins appeared in her bedroom doorway. "He pointed the gun," she said. "He never said a word." She said Cunningham stepped' between her and her husband as she rushed out of the room.

"Before I could even close the cupboard door, That was the first shot." Richmond said she was running down the fire escape when she heard a second shot. She ran to a neighbor's apart tary manslaughter and acquittal. Assistant District Attorney Nicholas Radoycis said that on Nov. 10, 1994, Thompkins, 34, of Penn Hills, trashed the Manchester apartment that belonged to his estranged wife, Brenda Richmond. The next day, when she was cleaning up the mess, he returned with a gun and shot the repairman, who was working for her landlord's insurance company.

Ronald Cunningham, 39, of the North Side, was blocking Thompkins from shooting his wife when Cunningham was shot twice, Ra The next day, she went back to clean up the mess. Cunningham was in the apartment to board up a window that had been broken during Thompkins' rage, Richmond said. While Richmond was in the: apartment with her sister and her niece, Thompkins again called. "I explained to him I wasn't going back this time. I was done.

I was tired," she said. "He said he was coming over to kill me." She said the telephone call scared her enough that she called ADVERTISING ment and called police. When she saw Cunningham again, he was lying outside with two gunshot wounds. "I saw a man lying there, dying, who saved my life," Richmond said. She still did not know his name.

Cunningham died an hour later. Cunningham worked for the Insurance Restoration Service division of Mistick Management Inc. He had been sent to the apartment to make repairs with co-worker Billy Griffiths. Griffiths testified during an earlier hearing that he was outside cutting plywood while Cunningham worked inside. Testimony in the trial will continue this morning.

He was 81 years old. Mr. McGraw was born in Oakmont, PA; the son of Mr. and Mrs. Thomas Henry McGraw.

He graduated from the Choate School and was a member of the Class of 1937 at Yale University. For 25 years, he was active in the coal industry in Western PA. After the sale of his business retired to Cape Cod, MA where he worked as a mortgage broker for many years. He was an accomplished sailor and golfer and was an avid competitor in both throughout his life. He is survived by his widow, Arden Gary Forde McGraw and their children, Sarah McGraw of Boston and Christopher McGraw of Centerville.

He is also survived by three children from a previous marriage, Charles Evans McGraw of San Rafael, CA, Mary Cosntance McGraw of Beaufort, SC, and Mar-ban M. Sparkman of Devon, PA; by his brother, John Sears McGraw of Pittsburgh, PA and three grandchil- dren. A son, Durban A. McGraw, Jr. and an infant daughter preceded him in death.
