1109 Federal SU North id. no Court Awards Sole Custody To Ex-Husband Morton Downey By The United Press BRIDGEPORT, June 7 Superior Judge Robert L. Munger Issued an order yesterday restraining Barbara Bennett, divorced earlier this week from Morton Downey, radio singer, from seeing her five children unless she is in a "condition of complete sobriety." Judge Munger granted Downey, who charged "intolerable cruelty," a divorce at a private, uncontested hearing Wednesday. Downey was granted custody of the children. The court handed down a written decision yestarday giving Downey "the exclusive care, custody and control of the minor children and of their education and religious rearing and training during their minority." The decision restrained Mrs.

Downey from "any interference whatever," though Judge Munger said she "shall have the right to see and visit such minor children at reasonable times, provided, however, that the defendant alone makes such visits unaccompanied by any other person or persons unless with the permission of the plaintiff." "The defendant at the time of any such visit or visits," the court ruled, "shall be in the condition of complete sobriety and shall conduct herself in the presence and hearing of such children with propriety becoming a good mother." Downey was given "the right at all times to be the sole judge of the sober conditions and propriety of the behavior and condition of the defendant in the presence and hearing of said children." Married in 1929, the Downeys were long considered "the perfect family" among screen and radio couples. Mrs. Downey announced early this year that she would seek separate maintenance and Downey, after an "attempt at filed for divorce here. Mrs. Downey is a sister of Con stance and Joan Bennett, movie actresses.

The children are Michael, 11, who was adopted; Sean Morton, Lowell Ann, Anthony Patrick, 6, and Kevin Peter, 3. They are living with Downey's mother at Wallingford. Barbara and Cowboy Elope to Mexico By The United Press HOLLYWOOD, June 6 Barbara Bennett, newly divorced wife cf Tenor Morton Downey, and Addison Randall, cowboy film hero, were believed today to be at Guaymas, where they intend to be mar ried. Miss Bennett, sister of Film Stars Joan and Constance Bennett, left by airplane with Randall for Mexico yesterday after informing mends they would be married there. Randall has appeared in pictures for several years and is a brother of Bob Livingston, also a cowboy actor.

June 7 The American Federation of Teachers (A. F. of last night revoked, the char-! ters of two New York City chapters and one Philadelphia local for "consistently" following "the Communist Party line." The revocation was ordered in a national referendum xby a vote of approximately 11,000 ft 8500 ineach case, the federation reported. These figures contained the votes of members of the three affected locals, the federation said, charging that the vote of other chapters was "80 per cent for ouster." Charters revoked included: New York Local 5, which with 6000 members is the second largest unit in the federation; New York Local 537, the college teachers' unit, and Local 192, Philadelphia teachers.

Both Borland and John Harriett are charged with the larceny of the auto. In addition Borland is accused of failing to stop following the collision between the two cars and is also accused of driving without a license.
